Where a court considered a community order appropriate, a period spent on remand was not a determinative factor in deciding what an appropriate sentence was. Even where an offender had served time on remand at least equivalent to the maximum custodial term that could properly be imposed for the offence, the Criminal Justice Act 2003 gave the sentencing court a discretion to impose a community order.
