Where the offence of indecent assault was committed as the prelude to unlawful sexual intercourse with a girl under 16 years old, a custodial sentence of no more than the maximum for the latter offence of two years should have been passed as the indecent assault could not properly be regarded as separate and distinct from the act of sexual intercourse.
