Text messages found on the defendant's phone which the Crown sought to adduce as evidence of an "implied assertion" that he was a drug dealer were not caught by the statutory code on hearsay in the Criminal Justice Act 2003 and, subject to any other objections to admissibility, could be admitted in evidence in the proceedings.
