[2012] EWCA Crim 2379

Pursuant to the Criminal Justice Act 2003, the only power to recall an offender who was on licence was held by the secretary of state. Effectively the courts had no power to do anything about revoking the licence of an offender who had committed further offences during the licence period of a previous sentence.
