[2009] EWCA Crim 1721
The giving of bad character evidence by a defendant in relation to a co-defendant without prior notice or application could well lead to the discharge of the jury and to a retrial, with the possibility of severe sanctions in the form at least of wasted costs orders against any legal representative found to have been involved in a deliberate manipulation of the rules leading to such consequences.
