[2009] EWCA Crim 2311

A pharmacist's conviction for placing on the market a medicinal product, namely counterfeit Viagra, without holding a marketing authorisation contrary to the Medicines for Human Use (Marketing Authorisations Etc.) Regulations 1994 Sch.3 para.1 was quashed as the transactions were neither intended to, nor had the effect of releasing a medicinal product into a distribution system which led to its sale to end users within the European Economic Area.
