In determining the appropriate level of penalty for health and safety breaches the court should take into account the degree of risk, the scope of risk and the degree of culpability for the breach. In considering the effect a fine would have on a company it was desirable for the court to have regard to the pre-tax profits of a company rather than its turnover.
