[2008] EWCA Crim 1019

A sentence of 16 months' imprisonment imposed upon a mentally disordered offender for communicating a bomb hoax was excessive where the hoax was manifestly false and had caused no fear or disruption; however, a custodial sentence was warranted in the interests of protecting the public and the emergency services from such acts.
