When sentencing for an offence, committed whilst subject to a community order, credit was not given for time spent on remand in custody for the original offence as it would be unjust under the Criminal Justice Act 2003 s.240(4)(b). The case of R. v Stickley (Joanna) [2007] EWCA Crim 3184, [2008] 2 Cr. App. R. (S.) 33 was not correctly decided.
