[2010] EWCA Crim 1327
Though a judge was peremptory in dismissing a defence application for an adjournment during his summing up in order for the defence to decide whether to re-open its case, that decision did not have such an effect upon the fairness of the trial that the safety of the jury's verdict was in question.
