The requirement under the European Convention on Human Rights 1950 Art.7(1) that no heavier penalty should be imposed than the one that was applicable at the time an offence was committed, referred to the maximum penalty prescribed by law for the offence in question at the time when it was committed and not the penalty that would probably have been imposed on a particular offender at the time.
