Proceedings that had resulted in the defendant's conviction of seeking to obtain leave to remain in the United Kingdom by deception contrary to the Immigration Act 1971 s.24A(1)(a) were a nullity; the defendant should have been charged with an offence under s.24(1)(aa) of the Act.
