R (on the application of C) v LEWES CROWN COURT (2009)

PUBLISHED March 25, 2009

[2009] EWHC 805 (Admin)

Prosecutors instructing an expert to give evidence in a case against a defendant who had been remanded in custody had failed to give him adequate instructions and had failed to consider the expert's report timeously when it was received. That had contributed to the trial being delayed, and meant that the prosecution had not conducted the case with sufficient diligence and expedition for the custody time limits to be extended.
