A magistrates' court had acted perversely in ordering a pre-sentence report which excluded the possibility of custody in respect of a 16-year-old guilty of assault and causing harassment, alarm or distress. The magistrates' court had taken a perverse view of provocation and had not followed the relevant sentencing guidelines.
