The state's obligation to provide legal aid arose if the fact of presenting his own case could be said to prevent the litigant from having effective access to the court. The test under the European Convention on Human Rights 1950 Art.6(1) was whether the court was put in a position where it really could not do justice in the case because it had no confidence in its ability to grasp the facts and principles of the matter on which it had to rule.
