A magistrate had erred in law in concluding that in the exercise of his discretion he was entitled to exclude the evidence of police constables under s.78 Police and Criminal Evidence Act 1984, having regard to the decision of the European Court of Human Rights in Teixera de Castro v Portugal (1998) 28 EHRR 101.
