The strength of an appellant's underlying case or his rights under the European Convention on Human Rights 1950 art.6 were irrelevant to whether the court had jurisdiction to hear an appeal against an extradition order where the time limits under the Extradition Act 2003 s.26 for serving a notice of appeal had not been complied with.
