Where an appellant complied with the content of the Crown Court's notice of hearing, which stated that she should give three clear days' notice if she wished to abandon her appeal otherwise she would have to pay costs, a respondent could nevertheless apply to the magistrates' court for costs under the Magistrates' Court Act 1980 s.109.
