The fact that an individual was in custody at the time of a trial, even if that trial occurred in a different jurisdiction to the one in which he was in custody, did not of itself mean that such an individual could not be said to have deliberately absented himself from the trial for the purposes of the Extradition Act 2003 s.20(3).
