Where, in proceedings for a civil recovery order under the Proceeds of Crime Act 2002, the unlawful conduct relied on was unlicensed trading, it was doubtful whether monies received for goods sold would amount to "property obtained through unlawful conduct" for the purposes of s.242 of the Act.
