Whether the defence under the Road Traffic Act 1988 s.172(4), that a vehicle owner did not know and could not reasonably have ascertained who the driver of the vehicle was when a road traffic offence had been committed, had been made out was to be assessed from the date the police requested details of the driver's identity and not earlier.
