A prosecution under the Social Security Administration Act 1992 s.116(2) could be started at any time from 3 months or 12 months, whichever period last expired. The time limits for a prosecution of an offence under s.112 of the Act had been satisfied where it had been brought within 12 months even though there had been some evidence available for a prosecution within 3 months, as the offence was a continuing offence and the investigations were ongoing.
