A court had erred where, in convicting a youth of using violence to secure entry to premises, it had drawn adverse inferences solely from his failure to answer questions at a police interview as opposed to drawing inferences from any suggestion that he relied upon a fact in his evidence at trial that he had not previously mentioned in interview.
