[2009] EWCA Crim 2519

Where a psychiatrist's report, saying that a defendant would have difficulty in giving evidence, had been requested by the defence two weeks before trial, its service one week into the trial and after the decision had been made that the defendant should not give evidence was a grave breach of the Criminal Procedure Rules 2005.
