A judge had been correct not to apply the sentencing guidelines for banking fraud when considering what sentence to impose for offences of conspiracy to defraud but the overall sentence of seven years' imprisonment was disproportionate and insufficient attention had been paid to the effect of making the sentences consecutive. The proportionate overall sentence was one of five-and-a-half-years' imprisonment.
