The Court of Appeal certified a point of law of general public importance. The point of law was whether an unlicensed, disqualified or uninsured driver would be guilty of causing death by driving contrary to the Road Traffic Act 1988 s.3ZB in circumstances where his manner of driving was faultless and the deceased had been, as a matter of civil law, 100 per cent responsible for causing the fatal accident or collision
