On a charge of selling intoxicating liquor to a person under the age of 18, magistrates had been entitled to refuse a late application to exclude a written statement from the underage witness where the statement along with photographs of the witness, taken at the time the offence was committed, had not unfairly deprived the defendant of his opportunity of raising a defence under the Licensing Act 1964 s.169A that her appearance was such that nobody could reasonably have suspected she was under 18.
