Where a request for withdrawal of summonses had been made on condition that duplicate Crown Prosecution Service summonses proceeded, there was no irregularity such as to vitiate the withdrawal of the summonses, when a few days after their withdrawal, the CPS summonses were also withdrawn; the continuation of the CPS proceedings was beyond the court's control.
