The decision of a chief constable to terminate the suspension of a chief inspector and accept his notice of retirement, which resulted in avoidance of disciplinary procedures, was flawed in the Wednesbury sense as the constable had failed to have regard to matters of public interest set out in the Home Office Guidance on disciplinary procedures of December 12, 2002, which were so clearly material to the decision.
