An order for the appellant's extradition to Poland was disproportionate given that she had been sentenced to a six-month term of imprisonment suspended for two years for stealing a relatively small amount of electricity, there had been a substantial time lapse since the commission of the offence, she had led an exemplary life whilst in the United Kingdom and her daughter was flourishing as a result, and her extradition would in the long-term destroy the family life that she had established in the UK with her daughter.
