Purported non-derogating control orders made by the Secretary of State for the Home Department against individuals were in fact derogating control orders that the secretary of state had no power to impose because the obligations imposed by the orders breached the individuals' right to liberty contrary to the European Convention on Human Rights 1950 Art.5.
