[2010] EWCA Crim 307

A defendant's failure to tell the police at interview what he subsequently said in evidence could form the basis for a direction in accordance with the Criminal Justice and Public Order Act 1994 s.34. However, where it was unclear whether the failure to raise the point in the course of interview amounted to a lie, a full Lucas direction was not warranted.
