For an application for compensation for wrongful conviction to be successful under s.133 Criminal Justice Act 1988 or Art.14.6 International Covenant on Civil and Political Rights there had to be the discovery or emergence of a new fact that showed beyond doubt that there had been a miscarriage of justice. The quashing of a conviction on appeal did not justify a legitimate expectation of compensation.
