Despite a procedural error made by a judge in thinking he had power of his own initiative, in the absence of a prosecutor's notice, to embark on confiscation proceedings, that error by itself did not destroy the court's jurisdiction either to postpone sentence or to make a confiscation order. As the offences dated back to 1995, the relevant provision for the conduct of the confiscation proceedings was the Criminal Justice Act 1988 s.72 .
