A conviction for sexual activity with a child was upheld, as the judge had been entitled to allow prosecution evidence of a similar incident over 10 years earlier for which the offender had received a caution, as it had similarities to the instant offence. There was no unfairness, even though the previous victim gave evidence at the trial, since the defence had had the opportunity to consider his witness statement before the trial.
