[2007] EWCA Crim 3290

A sentence of imprisonment for public protection was inappropriate for causing death by dangerous driving where the accident had occurred by reason of the defendant suffering an epileptic fit whilst driving as a consequence of not taking his medication, since it could not be said that there was a significant risk of his committing a further offence of the same kind.
