It was an abuse of process for the British authorities to have initiated and subsequently assisted in the procured deportation of the appellant by unlawful means in circumstances where there were specific extradition facilities between the UK and Zimbabwe. Despite the fact that there had been no challenge to the fairness of the trial itself the pre-trial conduct had rendered the conviction unsafe.
