A circuit judge hearing an application for a search warrant under s.9 Police and Criminal Evidence Act 1984 was required to consider whether the application should be in the form of a production order application made inter partes on notice. Warrants granted under s.9 of the Act must satisfy one or other of the access conditions to be found in Sch.1 to the Act. The judge was also required to give reasons for his decision.
