While a judge had the power to determine an application for disclosure under the Criminal Procedure and Investigations Act 1996 s.8 in the course of a preparatory hearing held under the Criminal Justice Act 1987 s.7(1) , he did not derive that power from s.9(3)(c) of the 1987 Act, and thus no appeal to the Court of Appeal would lie under s.9(11) , unless the application raised a question of law for his determination.
