Where one of the police officers involved in an arrest had become discredited following an investigation which culminated in disciplinary proceedings and a decision by the Crown Prosecution Service that he could no longer be regarded as a reliable witness, there was a real possibility that if the facts of that investigation had been before the jury at the trial, it would not have been bound to convict.
