R v C & ORS (2007)

PUBLISHED April 20, 2007

[2007] EWCA Crim 854

Whilst it was possible that the common law right of a jury to stop a case after the close of the prosecution case survived the application of the European Convention on Human Rights 1950 Art.6 it was clear from the authorities that the practice of inviting a jury to exercise such a right had been comprehensively disapproved of and at the very least could only be exercised in the most exceptional circumstances.
