A judge was fully entitled to exercise his discretion to dismiss submissions based on Arts.3 and Art.6 European Convention on Human Rights and rule that a child could be tried in an adult court. The judge was aware of what had been said on the matter in other cases and had duly considered the various adjustments made in respect of this particular child defendant.
