Where a defendant had pleaded guilty to possession of an identity document with improper intention under the Identity Documents Act 2010 s.4 after his legal representatives had failed to advise him of any potential defence under the Immigration and Asylum Act 1999 s.31, his conviction was nevertheless safe. The defendant was unlikely to have been able to establish refugee status as s.31 required, given the rejection of his asylum claim by the Home Secretary and First-tier Tribunal.
