Whilst thefts including shoplifting could cause harassment, alarm or distress and justify an anti-social behaviour order (ASBO) pursuant to the Crime and Disorder Act 1998 s.1, those offences did not automatically engage the section. Whether the section was engaged was dependent on the particular factual matrix of a case.
