Although an off-duty, plain-clothed police officer had not used the words "I am arresting you" when arresting an individual, there was sufficient evidence for the judge to conclude that a lawful arrest had been effected as the officer had explained that he was a police officer and was detaining the individual because he had seen him smash a car window.
