In the exceptional circumstances of the case, where an applicant's trial in his absence breached the European Convention on Human Rights 1950 Art.6 because he had not been afforded an adequate opportunity to challenge evidence adduced at the trial, it was not, pursuant to the Extradition Act 1989 s.6(2), in the interests of justice to return him to Italy on the ground of that conviction.
