Where a dismissed employee was reinstated by agreement of the parties after an internal appeal board with a sophisticated procedure found no grounds for dismissal, his subsequent dismissal was in breach of contract. There was no temporal qualification to an arrangement made under the Employment Rights Act 1996 s.212(3)(c) and it could be made retrospectively so that there was no gap in continuity of employment.
