In more complicated civil cases brought under the Proceeds of Crime Act 2002 and its predecessors, the Revenue should set out its case in points of claim and the defendant should respond in points of defence. In such cases it might then be appropriate for a list of issues to be drawn up in the way it was done in the Commercial Court.
