[2008] EWHC 2866 (Admin)

A conviction for breach of a planning enforcement notice issued under the Town and Country Planning Act 1990 s.179 was not incompatible with an offender's rights under the European Convention on Human Rights 1950 nor his rights under the Human Rights Act 1998 s.7, even though he had not been permitted to challenge the validity of the notice during criminal proceedings in the magistrates' courts.
