In the circumstances it was not desirable to order pre-action disclosure under CPR r.31.16(3) in order to dispose fairly of the anticipated proceedings for alleged fraud in relation to letters of credit and, even if that jurisdictional threshold had been crossed, the court would not have ordered disclosure as a matter of discretion.
